Recent broadcast fax laws enacted by congress established new guidelines allowing fax marketers and businesses to send unsolicited fax documents. Below is a brief overview of the guidelines posted in the new broadcast fax laws established in 2005.

Broadcast Fax Legally -- 3 Rules You Must Consider...

1.) Do You Have an Established Business Relationship?

The voluntary communication of a fax number within the context of an established business relationship means you can legally fax the entity which provided you with the fax number.

Example:
In accordance to the new law, when someone has:

  • filled out a form on your website
  • provided you with their business card
  • or recently sent you a letter or email with their fax number(s)
If any of the above conditions are meet then they are voluntarily relinquishing their fax number and giving you permission to use their fax number for additional business communications.

2.) Is the Fax Number Publicly Advertised?

If a business publishes its fax number in an open directory advertisement or site on the internet, they have voluntarily agreed to make the facsimile number available for public distribution.

Example:
In accordance to the new law, anyone who voluntarily advertises their fax number in a directory that is published in print or on the internet can be sent unsolicited faxes. If a business advertises its contact information on their web site and includes their fax number; this constitutes voluntary public distribution of their fax number for others to use in accordance to the law.

3.) Are You Providing a Cost-Free Way for Recipients to Request Removal?

If you are sending a fax advertisement, you must provide your recipients with a cost free way for them to request removal from receiving future faxes.

Example:
If you provide a toll free removal number such as a fax or voice number, those who want to be removed must contact you and request removal. You should maintain an opt-out data base so you can keep future faxes from going to those who have requested removal. If you need assistance, TierOne can maintain this data base for you.
